Terms of Use

These terms govern the use of the diving.rs website (the "site"). By using the site you confirm that you have read these terms and that you accept them. If you do not accept them, please do not use the site.

The site is run by Marko Veniger, a private individual, Milutina Milankovića 120a, 11000 Belgrade, Republic of Serbia ("we"). Contact: marko@diving.rs.

1. Diving is at your own risk

All information about dive locations, dive sites, depths, entries, conditions and underwater navigation is used entirely at your own risk.

Diving carries inherent risk to health and life. By accepting these terms you confirm that you are aware of this and that you take that risk upon yourself.

The information on the site:

• is not a dive plan and does not replace dive planning, equipment checks, a briefing or an assessment of conditions on site;
• is not training and does not replace formal dive training with a certified instructor;
• is not a guarantee that conditions at a location are the same as they were when the text was written.

2. For certified and fit divers only

The content of the site that describes dives is intended solely for people who:

• hold a valid certification from a recognised diving organisation for the type and depth of dive they undertake;
• are medically and physically fit to dive and, where required, hold a valid medical certificate;
• dive within the limits of their own training, experience and equipment.

Dives in an overhead environment — in caves, caverns and inside submerged structures, including the interior of the church at Valjevska Gračanica — require dedicated cave training, an appropriate equipment configuration and the use of a guideline. A description of such a dive on the site is in no case an invitation or a recommendation to undertake it.

If you do not meet the conditions above, do not use the information on the site as the basis for a dive.

3. Conditions at locations change

Water levels, visibility, temperature, thermoclines, entries and underwater landmarks change over time and with the season. The depths and distances given on the site are approximate. Before every dive, check the current state yourself and, where this is required, obtain permission from whoever manages the location.

4. Account

Signing in to the site is done through a Google account. You are responsible for the accuracy of the data you enter, and in particular for the certifications you declare. Entering inaccurate data about your qualifications can endanger you and other divers.

We reserve the right to restrict or close an account if the data proves inaccurate or if the site is used contrary to these terms. You can delete your account yourself, at any time, from the account page.

5. Notices and email

An inbox on the site comes with the account. Into it we send notices about what happens to your account — the outcome of a certification verification, decisions on club membership, decisions on a trip roster — and they always arrive there, because they are the record of your account.

The same notices may also be sent to the email address on your Google account. What goes to email is yours to choose, group by group, on the account page. We send no offers — courses, mentorship or dive trips — until you switch them on yourself. The other groups are on by default and you can switch them off at any time, either in the settings or through the unsubscribe link every message carries, without signing in.

Switching email off does not switch off the inbox on the site. How we process this data is described in the privacy policy.

6. Content you publish

You are responsible for the photographs, descriptions and other content you send us. By sending content you confirm that you have the right to publish it and that in doing so you infringe neither anyone else's copyright nor the right of the people shown to their own likeness.

By sending it to us you grant us a non-exclusive right to display that content on the site with attribution. We reserve the right not to publish content, or to remove it, without giving reasons.

7. Applications are not bookings

Sending an application for training, mentorship or a tank fill is an expression of interest, not a concluded contract. The date, price and terms are agreed separately, afterwards.

8. Limitation of liability

To the extent permitted by law, we are not liable for damage arising from use of the site, nor for damage arising during or in connection with a dive undertaken on the basis of information from the site. This limitation does not exclude liability that cannot be excluded under the law.

9. Third-party content

The site contains links to third-party sites and displays a map based on OpenStreetMap data. We are not responsible for the content or the availability of those services.

10. Changes to these terms

We may change these terms. The changed version applies from the day it is published on this page, and the date of the last change is given at the top.

11. Governing law

These terms are governed by the law of the Republic of Serbia. Disputes fall within the jurisdiction of the competent court in the Republic of Serbia.
